Review of the interactions between the Payment Services Directive (PSD) and the MiCA regulation
This month, Adan takes a look at the interactions between the Payment Services Directive (PSD) and the Market-in-Crypto-Assets Regulation (MiCA), and in particular at the issue raised by Adan last December: the assimilation of stablecoins (EMTs) to ‘funds’ within the meaning of PSD2. This interpretation could impose specific licensing requirements on issuers and Crypto Asset Service Providers (CASPs) in addition to those already required by MiCA, thereby increasing their operational constraints.
The article, designed as a simple explanation, presents the regulatory interactions between PSD2 and MiCA by exploring the issues for CASPs, particularly in terms of licensing and access to payment infrastructures. Since these issues were first identified, Adan has continued its in-depth work on the PSD regulations and has drafted amendments that have been submitted to the European level to ensure that these requirements are realistically adapted.
On a panel of leading experts – including Tony Ashraf (BlackRock), Christoph Hock (Union Investment), Jean-Marc Stenger (Société Générale – FORGE) and Thomas Wißbach (Deutsche Börse) – our President Faustine Fleuret gave Adan’s view of the conditions that Europe has put in place and is putting in place to encourage the development of crypto markets.
